A clearing in the forest: law, life, and mind.Steven L. Winter - 2001 - Chicago: University of Chicago Press.
Cognitive science is transforming our understanding of the mind. New discoveries are changing how we comprehend not just language, but thought itself. Yet, surprisingly little of the new learning has penetrated discussions and analysis of the most important social institution affecting our lives-the law. Drawing on work in philosophy, psychology, anthropology, linguistics, and literary theory, Steven L. Winter has created nothing less than a tour de force of interdisciplinary analysis. A Clearing in the Forest rests on the simple notion (...)

Curriculum Knowledge, Justice, Relations: The Schools White Paper (2010) in England.Christine Winter - 2014 - Journal of Philosophy of Education 48 (2):276-292.
In this article I begin by discussing the persistent problem of relations between educational inequality and the attainment gap in schools. Because benefits accruing from an education are substantial, the ‘gap’ leads to large disparities in the quality of life many young people can expect to experience in the future. Curriculum knowledge has been a focus for debate in England in relation to educational equality for over 40 years. Given the contestation surrounding views about curriculum knowledge and equality I (...)

The Principled Legal Firm: Insights into the Professional Ideals and Ethical Values of Partners and Lawyers[REVIEW]Richard Winter - 2011 - Journal of Business Ethics 98 (2):297 - 306.
Understanding how the professional ideals and values of partners influence lawyers' everyday life is a relatively unexplored area given the inherent difficulties of gaining access to lawyers. This case study sheds light on the professional ideals and ethical values of partners and lawyers in a mid-tier Sydney law firm. Semi-structured interviews with partners and lawyers/legal clerks reveal how partners' professional ideals and ethical values play a pivotal role in: (1) upholding positive normative evaluations of lawyer/firm propriety (...)

The Bed Crisis of Winter 1995-1996 in the British NHS: an illustration of accountability issues.Ann P. Young - 1999 - Nursing Ethics 6 (4):316-326.
The aim of this article is to explore the practical complexity of accountability in health care by focusing on a particular crisis affecting one NHS trust in the UK, that of insufficient beds to meet demand. It is presented through the eyes of five middle managers with nursing backgrounds. Although the focus is on their words, their expressions of distress and their awareness of conflict, these lead to a commentary highlighting some of the relationships between theory and practice, policy making (...)

Quantifying “Community Power” and “Racial Justice” in the Medical-Legal Partnership Literature.Alicia Turlington, Jonathan Young & Dina Shek - 2023 - Journal of Law, Medicine and Ethics 51 (4):748-756.
Medical-Legal Partnerships (MLPs) have been widely acclaimed for promoting health equity and achieving meaningful outcomes. Yet, little to no research has analyzed if this critical work has been done with communities — through meaningful engagement and building power — or if it has been done for communities without their involvement.

Ideals adrift: an educational approach to radicalization.Marion van San, Stijn Sieckelinck & Micha de Winter - 2013 - Ethics and Education 8 (3):276-289.
These days, the radicalization of young people is above all viewed as a security risk. Almost all research into this phenomenon has been carried out from a legal, criminological or socio-psychological perspective with a focus on detecting and containing the risks posed by radicalization. In the light of the political developments since September 11, 2001, this is entirely understandable but perhaps not altogether wise. Research and theory development from a pedagogical perspective can also make a significant contribution towards a (...)

Symbolism over substance? Large law firms and corporate social responsibility.Steven Vaughan, Linden Thomas & Alastair Young - 2015 - Legal Ethics 18 (2):138-163.
ABSTRACTAt its core, corporate social responsibility concerns the impacts of businesses on their surroundings. Despite their significant economic and geographic presence, and despite the varied disciplinary and conceptual lenses used to study CSR, there is very little existing work looking at law firms and their own CSR policies. This paper fills part of that gap. In August 2014, we reviewed the websites of the top 100 English law firms, as ranked by the trade publication The Lawyer. We were interested in (...)

Understanding Scientific Inquiries of Galileo’s Formulation for the Law of Free Falling Motion.Jun-Young Oh - 2016 - Foundations of Science 21 (4):567-578.
The purpose of this study is to gain a better understanding of the role of abstraction and idealization in Galileo’s scientific inquiries into the law of free falling motion, and their importance in the history of science. Because there is no consensus on the use of the terms “abstraction” and “idealization” in the literature, it is necessary to distinguish between them at the outset. This paper will argue for the importance of abstraction and idealization in physics and the theories and (...)

What were Shakespeare's final thoughts on history, tragedy, and comedy? Shakespeare's Last Plays focuses much needed scholarly attention on Shakespeare's "Late Romances." The work--a collection of newly commissioned essays by leading scholars of classical political philosophy and literature--offers careful textual analysis of Pericles, Prince of Tyre, Cymbeline, The Winter's Tale, The Tempest, All is True, and The Two Noble Kinsmen. The essays reveal how Shakespeare's thought in these final works compliments, challenges, fulfills, or transforms previously held conceptions of the (...)

‘To act is to be committed, and to be committed is to be in danger’: the vulnerability of the young lawyer in ethical crisis.Jane Ching, Graham Ferris & Jane Jarman - 2022 - Legal Ethics 25 (1):44-63.
This paper takes as its starting point the phenomenon of young lawyers in ethical crisis. The teaching of ethics in the classroom and the ethos and environment of the law firm have created dissonance: knowing what it is right to do but being unable to do it. In examining this phenomenon, we develop the idea of commitment as a source of duty, loyalty, and courage that enables someone to accept and overcome reluctance to act ethically. Our conceptual framework (...)

    Purity Balls.Nicole B. Doolen - 2016 - Stance 9 (1):73-83.
In this paper, I draw on the principles of Aristotelian ethics, the work of modern virtue ethicists, and previous feminist critiques of purity balls to interrogate the effects of this practice on moral development. I argue that purity balls discourage young women from making autonomous, informed, and virtuously motivated decisions regarding their sexuality. While most critiques of purity balls are rooted in the explicitly patriarchal structure of these events, my analysis emphasizes the negative impact they have on moral agency. (...)

The ArgumentIn the summer of 1783, a trial took place in the French city of Arras. One M. de Vissery, a resident of the nearby village of St. Omer, was appealing a decision by his local aldermen, who required him to remove a lightning rod he had put on his chimney. His young defense lawyer was Maximilien Robespierre, who made a name for himself by winning the case. Metaphors Lawyers Live by.Ljubica Kordić - 2023 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 36 (4):1639-1654.
The usage of metaphor in languages for specific purposes has been in the focus of interest of cognitive linguistics for years, especially after Lakoff and Johnson published their famous book “Metaphors We Live by” in 1980. Inspired by that book, the author strives to prove that metaphor was not only intensely present in the history of law but also that it pervades the language of contemporary legal theory and practice. Terms like _injury of law, the burden of evidence, soft laws, (...)

Don't tell terrible stories—everyone here has enough of their own. Everyone here has a whole bloody sack of terrible stories, and at the bottom of the sack is a hammer the narrator uses to pound you on the skull the instant you dare not believe your ears. Or to pound you when you do believe. Not long ago I saw a tomboyish girl on Khreshchatyk Street demand money of an elderly woman, threatening to bite her and infect her with syphilis. (...)

    Young children's earliest transitive and intransitive constructions.Michael Tomasello & Patricia J. Brooks - 1998 - Cognitive Linguistics 9 (4):379-396.
Much of children's early syntactic development can be seen as the acquisition of sentence-level constructions that correspond to relatively complex events and states of affairs. The current study was an attempt to determine the relative concreteness (verb-specificity) or abstractness (verb-generality) of such constructions for children just beginning to produce large numbers of multi-word utterances. Sixteen children at 2.0 years of age and sixteen children at 2,5 years of age participated (all English speaking). Each child was taught two novel verbs for (...)

By creating certain marks on paper, or by making certain sounds-breathing past a moving tongue-or by articulation of hands and bodies, language users can give expression to their mental lives. With language we command, assert, query, emote, insult, and inspire. Language has meaning. This fact can be quite mystifying, yet a science of linguistic meaning-semantics-has emerged at the intersection of a variety of disciplines: philosophy, linguistics, computer science, and psychology. Semantics is the study of meaning. But what exactly is "meaning"? (...)

This article provides an English translation of Johan Ludvig Heiberg’s “Literary Winter Crops” from 1843. The young Kierkegaard cultivated a positive relationship with Heiberg, who was the most powerful cultural figure in Denmark at the time. Heiberg published Kierkegaard’s first articles in his literary journal Kjøbenhavns flyvende Post, and in Kierkegaard’s early works such as From the Papers of One Still Living and The Concept of Irony, there are clear signs that he continued to court Heiberg’s favor. Several recent theorists have pointed out a range of data that seem to refute Kaplan's claim, but others (most explicitly Stalnaker 2014) have offered a principled argument that monsters are impossible. This paper interprets and resolves the dispute. Contra appearances, this is no dry, technical matter: it cuts to the heart of a deep disagreement about the fundamental structure of (...)

The present ecological crisis imposes a rethinking of the relation between the human being and the rest of nature. Traditional theological articulations of this relation have proven problematic where they foster separatism and anthropocentrism, which give a false report on the relation and have a negative impact on thinking and acting in relation to nature. One place to begin rethinking is through an exploration of the affirmation that the human being is “made in the image of God,”imago dei. Some ways (...)

In this paper, I will argue that ageing can be construed as disease. First, the concept of disease is discussed, where the distinction is made between two lines of thought, an objectivist and a subjectivist one. After determining the disease conception to be used throughout the argument, it is proposed that senescence could be seen as disease. Three common counterarguments are discussed, none of which appears strong enough to effectively counter the advocated view. In the third section, two potential implications (...)
